Terms of Use

1. General

1. Tzofar is a private technology service intended, among other things, to make alerts, updates and information relating to emergency situations accessible to users, as well as related features and services.
2. Tzofar is privately operated and developed by the operators of Tzofar (the "Operators"). Tzofar is not a governmental or public body and does not act on behalf of the Home Front Command, the IDF, the State of Israel, or any other competent authority.
3. These Terms apply to all Tzofar services and features, including the website, applications, push notifications, area- or location-based alerts, maps, alert history, sounds, spoken alerts, preliminary alerts, secondary alerts, messages and updates, and any other feature offered as part of the Service.
4. Use of the Service constitutes acceptance of these Terms. If you do not agree to them, you must refrain from using the Service.

2. Private and Supplemental Service Only

1. Tzofar is not an official alert system and is not intended to replace alert systems, applications, sirens, messages, media channels, or any other means operated by the Home Front Command or competent authorities.
2. You must not rely on Tzofar when deciding whether to enter or leave a protected space, change your location, or take or refrain from taking any other action concerning your safety or the safety of others.
3. In the event of any conflict, inconsistency or difference between information received through Tzofar and a notice or instruction issued by the Home Front Command or another competent authority, you must act in accordance with the official information and instructions.
4. The user is responsible for ensuring that appropriate official alert means are available to them and that they are familiar with the applicable Home Front Command instructions.
5. The receipt of an alert through Tzofar, or the absence of one, does not constitute confirmation that a danger does or does not exist in a particular area.

3. Nature of Alerts and Service Limitations

1. Tzofar makes efforts to provide a fast, accurate and continuous service. However, the Service is a technological service that depends on various systems, infrastructure and factors, some of which are beyond the Operators' control.
2. Accordingly, there is no guarantee that any alert or information will be received by the user; will be received at any particular time or without delay; will be received before an event, during it, or at all; will be complete, accurate, up to date or error-free; will correspond to the user's actual location; will be received only once; or will not be received when no action by the user is in fact required.
3. Among other things, there may be failure to receive an alert, a delay in receiving it, a false alert, an incorrect alert, a partial alert, a duplicate alert, assignment to an incorrect area, omission of an area or locality, incorrect or outdated information, and temporary or complete interruption of the Service.
4. Such failures may result, among other things, from the source of the information; delay in receiving the information; a failure of Tzofar servers or other infrastructure; unusual load; failure or delay in Push services; Apple, Google or other third-party services; the internet or cellular connection; the operating system; device settings; permissions; battery-saving mode; background activity restrictions; "Do Not Disturb" or silent mode; device failure; user settings; selection of areas or localities; or any other factor, whether or not under the Operators' control.
5. Even when the information on which an alert is based originates from an official authority, this does not make Tzofar an official service or create any undertaking by the Operators that the information will be received, processed, displayed or sent without delay or error.

4. Preliminary Alerts, Secondary Alerts and Supplemental Information

1. Tzofar may offer various types of messages and information in addition to official alerts, including preliminary alerts, secondary alerts, updates, assessments or supplemental information.
2. Such information is intended solely as supplemental information. It must not be regarded as an official instruction to enter or leave a protected space or take any other action, unless such action is also required under the instructions of the official authorities.
3. The nature, source, availability and level of accuracy of the various types of information may change from time to time.
4. The absence of a preliminary alert, secondary alert or other message must not be taken to mean that danger is not expected or does not exist.

5. Location-Based Alerts and Services

1. Tzofar may allow alerts to be received based on the device's location.
2. Matching areas to the location may depend, among other things, on the device's location services, their accuracy, permissions granted to the application, the operating system and additional technological factors.
3. There is no guarantee that area identification will be accurate at all times. The user must not rely on this feature as the sole means of selecting alert areas.
4. Users are advised to periodically verify that the alert settings and areas selected in Tzofar meet their needs.

6. User Responsibility

1. The user is responsible for the settings selected in the Service, including localities, areas, alert types, sounds, permissions and system settings.
2. The user is responsible for the proper functioning of their device, its network connection, the permissions granted to Tzofar, and ensuring that the operating system allows the application to receive and display notifications.
3. The user must have and use the appropriate official alert means and must not rely on Tzofar as the sole means of receiving alerts.

7. No Warranty and Service Availability

1. The Service is provided on an AS IS and AS AVAILABLE basis, as it is and as available from time to time.
2. Subject to any mandatory provisions of applicable law, the Operators make no express or implied representation or warranty regarding the Service's availability, continuity, speed, reliability, accuracy, completeness, fitness for a particular purpose, or freedom from faults.
3. The Operators may perform maintenance, changes, updates or other actions that may cause temporary interruption of the Service.
4. The Operators may change, add, limit, suspend or discontinue any feature or part of the Service, or the Service as a whole, at any time, subject to applicable law.

8. Limitation of Liability

1. Tzofar is used with the understanding that it is a supplemental service only and must not be relied upon as an official or sole means of receiving alerts.
2. Subject to applicable law and to the fullest extent permitted by law, the Operators shall not be liable for any damage, loss, expense or consequence caused by or in connection with the use of Tzofar, or by reliance on information displayed or not displayed through it.
3. Without limiting the foregoing, and subject to applicable law, the limitation of liability applies, among other things, to damage or loss arising from or relating to failure to receive an alert; delayed receipt of an alert; a false or incorrect alert; incorrect, missing, partial or outdated information; incorrect identification of a location, locality or area; failure, shutdown or unavailability of the Service; failure of a device, operating system, network, Push service or third-party service; any action taken or not taken as a result of information received or not received through Tzofar; or any change, suspension or discontinuation of the Service or any part thereof.
4. Subject to applicable law, the Operators shall not be liable for any indirect, consequential, special or incidental damages, or for any loss of profit, income, information or opportunity arising from the use of, or inability to use, the Service.
5. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

9. Third-Party Services and Systems

1. The Service may rely on third-party services, infrastructure or systems, including operating system providers, Push services, cloud services, maps, communications services and other technology services.
2. The Operators do not have full control over the operation or availability of such services, and their use may also be subject to the terms of those third parties.
3. Links to external websites or services, if displayed in Tzofar, are provided for user convenience and do not constitute endorsement, responsibility or any undertaking by the Operators regarding their content.

10. Use of Tzofar Systems, Information and Interfaces

1. No unauthorized use may be made of Tzofar's systems, servers, interfaces, API, endpoints, information-distribution mechanisms, or information obtained from them, including for scraping, collection, monitoring, copying, processing, storage, redistribution, or operation of any service, application, website, bot or other system based on them, unless the prior express written authorization of the Tzofar Operators has been obtained. The mere technical ability to access any information or interface does not constitute authorization to use it.
2. The Tzofar Operators reserve all rights with respect to the Service's systems and interfaces and, in the event of unauthorized use, may, subject to applicable law, take any technical or legal measure available to them to prevent, restrict or terminate such use and to protect the Service, its systems and the Operators' rights, without prejudice to any right, claim or remedy available to them under applicable law.
3. Even where authorization to use Tzofar information or an interface has been granted, this does not constitute any undertaking as to the availability, continuity, accuracy, completeness or speed of the information, and all limitations and limitations of liability set out in these Terms shall also apply to such use. The recipient of the authorization is solely responsible for how it processes, modifies, displays, distributes or otherwise uses the information, and the authorization does not create any representation that its service is operated, approved or supported by Tzofar, unless expressly stated otherwise in writing.
4. Subject to applicable law, the Tzofar Operators shall not be liable for any information, alert, error, delay, false alert, omission, modification or damage created or caused within a third-party service that uses information originating from Tzofar, whether such use is authorized or unauthorized.

11. Intellectual Property

1. The rights in Tzofar, including the software, code, design, user interface, service name, marks, graphics, original databases and original content, belong to the Operators or the relevant rights holders, as applicable.
2. The protected components of the Service may not be copied, reproduced, distributed, sold, made available to the public, reverse engineered, or used commercially without authorization, unless expressly permitted by law or prior authorization has been obtained.
3. Nothing herein grants the Operators rights in information belonging to third parties or in public or official information in which the Operators hold no rights.

12. Privacy

Use of Tzofar is also subject to the Tzofar Privacy Policy, which forms an integral part of these Terms and describes the types of information processed as part of the Service and how such information is used.

13. Changes to the Terms

1. The Operators may update these Terms from time to time, including as a result of changes to the Service, technology, applicable law, or the manner in which Tzofar operates.
2. The date of the latest update will be displayed at the top of this document.
3. Where a change is material, reasonable efforts will be made to bring it to users' attention by an appropriate means.
4. Continued use of the Service after updated Terms take effect will be subject to the updated Terms, subject to applicable law.

14. Governing Law and Jurisdiction

1. These Terms and the use of Tzofar shall be governed by the laws of the State of Israel.
2. Any dispute relating to the Service shall be heard before a court of competent jurisdiction in accordance with applicable law.

15. Miscellaneous

1. If any provision of these Terms is determined to be unlawful, invalid or unenforceable, this shall not, to the extent permitted by law, affect the validity of the remaining provisions.
2. The Operators' failure to exercise any right does not constitute a waiver of that right.
